Terms of Service

These terms govern your use of The Light We Kept. By using the service, you agree to them. Please read the acceptable-use section carefully — it matters most for a tool that edits photos of real people.

1. The service

The Light We Kept provides AI tools to animate, restore and colourise, and edit your photos — including adding a person who wasn’t in the original (“wish you were here”). Results are produced by AI.

2. Who can use it

You must be at least 18 years old and able to enter a binding agreement.

3. Acceptable use & consent

You may upload and edit only photos that you own or have the rights to use, and that include only people who have consented to this use — or, for a deceased loved one, where you are a family member or otherwise have the right to create such a remembrance.

You must not use The Light We Kept to:

create or alter images of anyone without their consent;
impersonate, defame, harass, threaten, or mislead;
depict a person in a false, harmful, sexual, or defamatory way;
create deceptive, fraudulent, or unlawful content, or anything that violates someone’s privacy, publicity, copyright, or other rights;
upload illegal content, or content that sexualises or exploits minors.

We may remove content and suspend access for violations. To report misuse, email hello@thelightwekept.com.

4. AI-generated results

Results are AI approximations and may not perfectly match real appearances, expressions, or events. The “wish you were here” feature creates a heartfelt remembrance — not a real photograph or a factual record of an event. You are responsible for how you use and share your results.

5. Your content and ownership

You keep all rights to the photos you upload. By using The Light We Kept, you grant us a limited licence to process and store your photos solely to provide the service to you (including via our AI provider). We don’t claim ownership of your photos or your results, and we don’t use them to train AI models.

6. Payments, pricing and refunds

Prices are shown on the site and may change. Purchases are processed by our payment provider Stripe. If you’re not happy with a keepsake, contact us and we’ll redo it or refund it, in line with our redo-or-refund promise.

7. Privacy

Our Privacy Policy explains how we handle your data.

8. Disclaimers

The service is provided “as is”, without warranties of any kind. We don’t guarantee specific results, accuracy of AI output, or uninterrupted availability.

9. Limitation of liability

To the maximum extent permitted by law, The Light We Kept and [legal entity] will not be liable for indirect, incidental, or consequential damages, and our total liability is limited to the amount you paid us in the 3 months before the claim.

10. Governing law

These terms are governed by the laws of [your country / state], and any disputes will be handled by the courts of [jurisdiction].

11. Changes

We may update these terms. Continued use after changes means you accept the updated terms.
